सुप्रीम कोर्ट के न्यायमूर्ति संदीप मेहता ने राजस्थान हाईकोर्ट के कार्यवाहक मुख्य न्यायाधीश एस.पी. शर्मा को लेकर गंभीर चिंता जताई है। रिपोर्ट के अनुसार, न्यायमूर्ति मेहता ने भारत के मुख्य न्यायाधीश सूर्यकांत को पत्र लिखकर कार्यवाहक मुख्य न्यायाधीश के तबादले और किसी अन्य हाईकोर्ट से नए मुख्य न्यायाधीश की नियुक्ति का अनुरोध किया है।
जानकारी के मुताबिक, इस संबंध में न्यायमूर्ति संदीप मेहता ने इस महीने सुप्रीम कोर्ट कॉलेजियम के अन्य सदस्यों को भी तीन पत्र भेजे हैं। पत्रों में उन्होंने न्यायमूर्ति एस.पी. शर्मा पर शक्तियों के दुरुपयोग और रोस्टर में हेरफेर से जुड़े आरोपों का उल्लेख किया है।
न्यायमूर्ति मेहता ने उठाए ईमानदारी पर सवाल
पत्रों में न्यायमूर्ति मेहता ने कहा कि उन्हें कई शिकायतें मिली हैं, जिनके कारण राजस्थान हाईकोर्ट के कार्यवाहक मुख्य न्यायाधीश की ईमानदारी को लेकर संदेह पैदा होता है। उन्होंने न्यायमूर्ति शर्मा के आचरण को लेकर संस्थागत हितों पर भी चिंता व्यक्त की।
न्यायमूर्ति मेहता ने मुख्य न्यायाधीश सूर्यकांत से अनुरोध किया कि न्यायमूर्ति शर्मा को उनके कथित अनुचित आचरण को देखते हुए तत्काल राजस्थान से बाहर किसी अन्य हाईकोर्ट में स्थानांतरित किया जाए।
नए मुख्य न्यायाधीश की नियुक्ति का अनुरोध
सुप्रीम कोर्ट जज ने यह भी अनुरोध किया कि राजस्थान हाईकोर्ट में किसी अन्य हाईकोर्ट से नए मुख्य न्यायाधीश की नियुक्ति की जाए। उनका कहना है कि ऐसा कदम न्यायिक संस्थान के हित में होगा।
यह मामला इसलिए भी महत्वपूर्ण माना जा रहा है क्योंकि किसी मौजूदा हाईकोर्ट के कार्यवाहक मुख्य न्यायाधीश के खिलाफ सुप्रीम कोर्ट के वरिष्ठ न्यायाधीश द्वारा इस तरह की गंभीर आपत्तियां उठाया जाना न्यायिक हलकों में असामान्य घटनाक्रम है।
आरोपों की स्वतंत्र पुष्टि जरूरी
हालांकि, सामने आए आरोपों के संबंध में अंतिम निष्कर्ष निकालने से पहले संबंधित पक्षों का पक्ष और आधिकारिक जांच की स्थिति स्पष्ट होना जरूरी है। लगाए गए आरोपों को फिलहाल आरोप के रूप में ही देखा जाना चाहिए, न कि स्थापित तथ्य के रूप में।

In an unusual development, Supreme Court Justice Sandeep Mehta has reportedly written to Chief Justice of India Surya Kant seeking the transfer of Rajasthan High Court Acting Chief Justice S P Sharma to another High Court.
According to the reported correspondence, Justice Mehta also requested that a new Chief Justice from another High Court be appointed to Rajasthan.
Three Letters Sent to Collegium Members
Justice Sandeep Mehta is understood to have written three letters earlier this month, which were also marked to other members of the Supreme Court Collegium.
In the letters, Justice Mehta reportedly raised allegations concerning misuse of powers and roster manipulation. He also referred to several complaints that, according to him, raised doubts about Justice S P Sharma’s integrity.
Request for Immediate Transfer
Justice Mehta reportedly urged the Chief Justice of India to transfer Justice Sharma out of Rajasthan immediately, citing what he described as conduct unbecoming of the office.
He further indicated that failing to take such action would be against the interests of the judicial institution.
New Chief Justice Sought for Rajasthan High Court
The Supreme Court judge has also sought the appointment of a new Chief Justice to the Rajasthan High Court from another High Court.
The development is significant as it involves serious allegations against a serving Acting Chief Justice being raised by a sitting Supreme Court judge. Such an intervention is considered unusual within the higher judiciary.
Allegations Yet to Be Independently Established
The allegations mentioned in the reported letters should not be treated as established facts unless they are confirmed through an official inquiry or competent authority. The response of Justice S P Sharma and any subsequent action by the Supreme Court Collegium will be important in determining the next course of action.
